Green Card through the EB-5 Pilot Program Step by Step

  • During the initial consultation attorney Elizabeth Krukova will answer all your questions in order to determine your eligibility for the EB-5 Program;
  • Upon signing a Retainer agreement with National Capital, we will start working on your case and will provide you with the list of documents required for the EB-5 petition;
  • You need to choose a Regional Center and an EB-5 investment project you would like to invest in (you are welcome to make this choice by yourself, or we can arrange services of a consulting firm to assist you on this matter);
  • Complete the underwriting process with the Regional Center and transfer investment capital to Regional Center escrow account;
  • National Capital will prepare and file Petition by Alien Entrepreneur on your behalf;
  • Petition by Alien Entrepreneur is approved (processing time is usually 4-6 months from the date of filing);
  • If you are already in the United States on any nonimmigrant visa, National Capital will file Application for Adjustment of Status to Permanent Residence on your behalf. If you reside outside of the US when your Petition by Alien Entrepreneur is approved, we will assist you while undergoing consular processing through National Visa Center and you will obtain your immigrant visa in the US consulate abroad. (we will prepare all documents within a month);
  • Your immigrant visa will be issued after the interview at the US Embassy, and you will enter the US on permanent resident status. If you are already in the US, you will receive an Approval Notice for your Application to Adjust Status to Permanent Residency, the EB-5 green card. (Processing time for Application for conditional green card usually takes 5-7 months);
  • Your conditional green card is valid for 2 years. During this period you are not obligated to actively participate in management of your investment. You and your family members have a freedom to live, work and study everywhere in the United States as within the first 2 years of residency as in the future.
  • National Capital will file Petition by Entrepreneur to Remove Conditions 3 months before your conditional green card expires.
  • Petition to Remove Conditions is approved (processing time is usually 5-6 months from the date of filing); you will receive your permanent resident card for 10 years.
  • You can apply for US citizenship after 3 years of being a permanent Green Card holder.
